1. Who We Are

This website is operated by Twin Palms Advisors Co., Ltd. (operating Jam Kham / จำคำ), a company incorporated in Thailand with registered office at 52/9 หมู่ที่ 2 ต.วิชิต อ.เมืองภูเก็ต จ.ภูเก็ต 83000, Thailand. In these terms, "we," "us," and "our" mean Twin Palms Advisors Co., Ltd. You can reach us at support@jamkham.com.

2. Acceptance

By accessing or using jamkham.com, you agree to these Website Terms of Use and to our Privacy Policy and Cookie Policy. If you do not agree, please do not use the site. We may update these terms from time to time; the "Last updated" date above shows when, and your continued use of the site means you accept the current version.

3. What These Terms Cover

The marketing site exists to explain the product and let you join the email list or request early access. It does not provide the learning service itself. Any account, learning activity, subscription, or purchase takes place in the Jam Kham app at app.jamkham.com, which is governed by its own Terms of Use and Privacy Policy. Purchases are governed by the app's Terms of Use and Refund Policy (our Refund Policy page is a copy of it), and are sold as described in Section 4. If anything described on this site conflicts with the app's terms regarding your account or a purchase, the app's terms govern.

Any prices, plans, or features described on this site are for general information only and may change. They do not constitute an offer, and no purchase is made on this site.

4. Who Sells to You

Purchases are made in the Jam Kham app, not on this site, and the app's Terms of Use govern them. This section summarises how they are sold.

Outside Thailand, paid access to the Read Thai and Speak Thai courses is sold through a reseller named at checkout (the "Reseller"), which acts as our merchant of record: Paddle, or Sold through Link, LLC ("Link"), an affiliate of Stripe. The merchant of record is the company that sells the course to you, charges your payment, collects any sales tax or VAT, issues your receipt and handles refunds. Each purchase is sold by one Reseller only: either Paddle or Link. Which one sells your purchase is decided at the time of purchase, and it is named on the checkout page and on your receipt. The other Reseller has no role in that purchase.

If Paddle is the Reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

• Your purchase is governed by Paddle's Buyer Terms and Paddle's Refund Policy, and Paddle handles your payment data under its Privacy Policy.
• To view your receipt, manage or cancel a subscription, or request a refund, use the link in the email Paddle sends you after purchase, or look up your order at paddle.net.
• Card payments appear on your statement as "PADDLE.NET*" followed by a shortened business name. PayPal payments appear as "PAYPAL *PADDLE.NET".

If Link is the Reseller

Our order process is conducted by our online reseller Sold through Link, LLC ("Link"), an affiliate of Stripe. Link is the Merchant of Record for all orders it processes. Link provides customer service for those orders and handles refunds and returns through Link support. Checkout and your receipt show these orders as "Sold through Link", and Link sends your receipts and invoices.

• Your purchase is governed by the Sold Through Link Terms, which form part of Link's consumer terms; the Stripe company you contract with under them depends on where you live (see Link's contracting-entity page). Link handles your payment data under the Link Privacy Policy.
• To view your orders or manage or cancel a subscription, sign in to your Link account at link.com, or use your Subscription page in Jam Kham. To request a refund or get help with a payment, contact Link support at support.link.com/topics/sold-through-link.
• Card payments appear on your statement as "LINK.COM*" followed by a shortened business name.

For orders, payments, receipts, cancellations and refunds, contact the Reseller named on your receipt: Paddle at paddle.net, or Link at support.link.com/topics/sold-through-link. For help using the courses, contact us at support@jamkham.com.

The companies behind Jam Kham

• Tembusu Ventures LLC (Delaware, United States; registered office 16192 Coastal Highway, Lewes, Delaware 19958) is our authorised reseller for purchases outside Thailand. The Reseller resells the courses through Tembusu. Tembusu Ventures LLC (Delaware, USA) holds the Paddle and Stripe accounts through which your purchase is sold.
• Twin Palms Advisors Co., Ltd. (Thailand) licenses the Read Thai and Speak Thai courses to you and operates the service.

If you purchase directly from Twin Palms within Thailand and pay in Thai baht, Twin Palms is the seller and merchant for that purchase; the Reseller and Tembusu are not involved.

5. Email Sign-ups and Early Access

If you submit your email address to join the list, request a free resource, or apply for early access, you agree we may contact you about Jam Kham as described in our Privacy Policy. Early access is offered at our discretion and is not guaranteed. You can unsubscribe from marketing emails at any time.

6. Acceptable Use of the Site

When using this site, you agree not to:

• Use the site for any unlawful purpose or in violation of these terms
• Attempt to gain unauthorized access to, interfere with, or disrupt the site or its servers
• Scrape, crawl, harvest, or collect data from the site using automated means without our permission
• Reverse engineer or attempt to extract source code from the site
• Upload or transmit malware, viruses, or other harmful code
• Misrepresent your identity or submit another person's personal information without authorization
• Copy, reproduce, or redistribute site content except as permitted in Section 7

7. Intellectual Property

The marketing site and its content — including text, graphics, logos, design, screenshots, and the names "Jam Kham" and "จำคำ" — are owned by Twin Palms Advisors Co., Ltd. or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive licence to view the site for the purpose of learning about the product. You may not copy, modify, distribute, or create derivative works from the site, or use our trademarks, without our prior written permission.

8. Third-Party Links

The site may link to third-party websites and services (for example, the app, blog resources, or social media). We are not responsible for the content, practices, or availability of those third parties, and your use of them is subject to their own terms.

9. Disclaimers

The marketing site and its content are provided on an "as is" and "as available" basis, for general informational purposes only, without warranties of any kind, express or implied. Statements on the site about the product, learning methods, or outcomes are descriptive and are not a guarantee of any specific result. We do not warrant that the site will be uninterrupted, timely, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Twin Palms Advisors Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the marketing site. Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability that cannot be excluded under mandatory consumer-protection law in your country of residence. These limitations relate only to your use of the marketing site and do not affect any rights you have under the app's own Terms of Use.

11. Governing Law

These Website Terms of Use are governed by the laws of the Kingdom of Thailand, without regard to conflict of law principles, and the courts of Bangkok, Thailand shall have jurisdiction, subject to the consumer carve-out below.

Consumer rights carve-out: If you are a consumer, nothing in this Section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may be entitled to bring proceedings in the courts of that country.
